CBD: 0.19% maximum and a THC impurity cap

Cannabidiol (CBD) gets its first EU cosmetic limit: 0.19% in leave-on, rinse-off and oral care products, with THC impurities kept below 2.5 ppm.

What changes

CBD (from hemp with low THC) is allowed in EU cosmetics but has had no specific limit. Based on the SCCS advice of 26 March 2026, the draft sets a maximum of 0.19% in leave-on, rinse-off and oral care products, and requires delta-9-THC present as an impurity not to exceed 0.00025% (2.5 ppm). Many CBD creams and oils on the market use higher concentrations and will need reformulation. Hemp seed oil (Cannabis Sativa Seed Oil) is a different ingredient and is not covered by this CBD entry.

Key dates

Not yet adopted. The draft was notified to the WTO on 8 July 2026 (comments until 6 September 2026), backed by the Standing Committee on Cosmetic Products and sent to the Council on 21 September 2026 for the three-month scrutiny period of the regulatory procedure with scrutiny. It will enter into force 20 days after publication in the Official Journal; non-compliant products may not be placed on the market from 12 months after entry into force and may not be made available (sold) from 24 months after entry into force. If published around January 2027, that means roughly early 2028 and early 2029. Exact dates are unconfirmed until publication.
