What changes
Under Article 15 of the Cosmetics Regulation, substances with a harmonised CMR classification must be banned unless an exemption is requested; none was requested for this batch. The draft adds about a dozen substances to Annex II, including dinitrogen oxide (nitrous oxide, used as a propellant in some foams and sprays), ozone, tetrahydrofurfuryl methacrylate (found in some gel-nail and artificial nail products), 2-ethylhexanoic acid monoester with propane-1,2-diol, trimethyl phosphate and α-methylstyrene. Like the 2025 TPO ban, there is no sell-off period: affected products must leave the market by the application date.
Key dates
| Cannot be placed on the market from | 1 February 2027 |
|---|---|
| Cannot be made available (sold) from | 1 February 2027 |
Both date fields give the date from which non-compliant products may no longer be placed on or made available on the market (no sell-off period). The 1 February 2027 date is fixed: it is the application date of Delegated Regulation (EU) 2025/1222 (OJ 20.6.2025) and is written into recital 39 of the Omnibus IX draft. The amending cosmetics act itself is still awaiting adoption and publication; if publication slips past that date, the ban will apply from its entry into force.
