Omnibus VIII: silver, hexyl salicylate and new CMR bans

Since 1 May 2026, substances classified as CMR by Delegated Regulation (EU) 2024/2564 are banned, while silver powder, hexyl salicylate and o-phenylphenol stay allowed under strict conditions.

What changes

Silver in nano form and massive silver (particles of 1 mm or more) are now prohibited; micron-sized silver powder (100 nm–1 mm) remains allowed only up to 0.05% in toothpaste and mouthwash and, as the colourant CI 77820, up to 0.2% in lip products and eye shadows, which affects glittery and metallic make-up. Hexyl salicylate, a common fragrance ingredient, is restricted by product type (from 2% in hydroalcoholic fragrances down to 0.001% in oral care) with limits for children’s products. o-Phenylphenol keeps its preservative limits (0.2% rinse-off, 0.15% leave-on, as phenol), is joined by its sodium salt, and is excluded from oral and inhalable products. Several other CMR substances were added to Annex II, and perborates are now banned as a single group.
